Title attribute in menu / H1 logo (SEO)

Hello,
Still lovin' this template. Two things to alter for SEO purposes.
The logo has an H1 tag. Can that be changed to a <p> or if that can't be done a H3?
About the menu. When using JAW menu, the title attribute is causing duplicate menu items. Off course i can choose not to fill in the title attribute (then there is no duplicate menu title), but that would be a bad decision for SEO.
Is there a solution on both matters?
